ORDINANCE NO. 1323
AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 2 OF THE CODE OF THE CITY OF OSWEGO, KANSAS, AND ADOPTING BY REFERENCE THE SUBDIVISION REGULATIONS OF THE CITY OF OSWEGO, KANSAS, FEBRUARY 2014, EDITION, PREPARED BY THE OSWEGO PLANNING COMMISSION.
WHEREAS,the Oswego Planning Commission has determined that the management and evaluation of new land uses within the corporate limits of the City of Oswego, Kansas, would best be handled through rules and regulations adopted under the authority of K.S.A. 12-741 et seq; and,
WHEREAS,the Oswego Planning Commission has prepared the Subdivision Regulations for the City of Oswego, Kansas, February, 2014, Edition; and,
WHEREAS, pursuant to K.S.A. 12-3009, the City of Oswego is authorized to incorporate a standard or model code or ordinance in booklet or pamphlet form by reference, which provisions shall be as much part of the ordinance as if the same had been set out in full in this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS, that:
SECTION 1. All of Article 2, Chapter 16 of the Code of Oswego, Kansas, is hereby repealed
SECTION 2. New Section 16-201 of the Code of the City of Oswego, Kansas, shall read as follows: “The Subdivision Regulations of the City of Oswego, Kansas, February 2014, Edition, prepared by the Oswego Planning Commission, is by reference incorporated in and by this publication made part of this chapter and article as fully as though set out at length herein and is adopted as the
Subdivision Regulations for the City of Oswego, Kansas.”
SECTION 3. New Section 16-102 of the Code of the City of Oswego, Kansas, shall read as follows: “No fewer than three (3) copies of the Subdivision Regulations marked “Official Copy as Incorporated by Ordinance No. 1323 of the City of Oswego” and to which shall be attached a published copy of this ordinance, shall be filed with the City Clerk to be open for inspection and available to the public at all reasonable business hours.”
SECTION 4. This Ordinance shall be included in the Code of the City of Oswego, Kansas, and shall be in full force and effect from and after it publication once in the official city newspaper.
