ORDINANCE NO. 1299

AN ORDINANCE REGULATING PUBLIC OFFENSES WITHIN THE CORPORATE LIMITS OF THE CITY OF OSWEGO,
KANSAS; INCORPORATING BY REFERENCE THE "UNIFORM PUBLIC OFFENSE CODE FOR KANSAS CITIES," EDITION
OF 2012, WITH CERTAIN OMISSIONS, CHANGES AND ADDITIONS; PRESCRIBING ADDITIONAL REGULATIONS;
ORDINANCE NO.1276.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:

SECTION 1.  INCORPORATING UNIFORM PUBLIC OFFENSE CODE.  There is hereby incorporated by reference for
the purpose of regulating public offenses within the corporate limits of the City of Oswego, Kansas, that certain
code known as the "Uniform Public Offense Code," Edition of 2012, prepared and published in book form by the
League of Kansas Municipalities, Topeka, Kansas, save and except such articles, sections, parts or portions as are
hereafter omitted, deleted, modified or changed.  No fewer than three copies of said Uniform Public Offense Code
shall be marked or stamped "Official Copy as Adopted by Ordinance No. 1299," with all sections or portions thereof
intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached
a copy of this ordinance, and filed with the city clerk to be open to inspection and available to the public at all
reasonable hours.

SECTION 2.  Subsection 6.16 of Article 6 of the Uniform Public Offense Code relating to Giving a Worthless Check
 is hereby omitted and deleted.

SECTION 3.  Subsection 10.6 of Article 10 of the Uniform Public Offense Code relating to Air Gun, Air Rifle, Bow
and Arrow, Slingshot, Paintball Gun or BB Gun are hereby omitted and deleted.  The following will apply toward
Air Gun, Air Rifle, Bow and Arrow or BB Gun:

All weapons must be used in a safe manner.  Persons under eighteen years shall not shoot any type of weapon
except under the direct supervision of a responsible adult.    
(a) Shooters must use a proper backstop, large and strong enough to stop any type of projectile used. 
(b)  Shooters must not shoot in the direction of other property owners unless a proper backstop is in place. 
(c)  Shooters may not shoot across alley or roadways. 
(d)  Shooters shall not shoot while on another person’s property.
The following will apply toward Paintball Guns:  Paintball guns shall not be used except within the confines of
a building or other structure from which the projectiles cannot escape.

SECTION 4.  Sections 11-101 and 11-102 of the Code of the City of Oswego, Kansas are hereby amended.

SECTION 5.  This ordinance shall take effect and be in force from and after its publication in the Labette Avenue.
