ORDINANCE NO. 1357

AN ORDINANCE PROVIDING FOR THE VACATION OF ALL OF THE PLATTED ALLEY IN BLOCK 13, COWELLS ADDITION AND VACATION OF ALL OF THE PLATTED ALLEY IN BLOCK 52, (MAXON’S ADDN) ORIGINAL CITY, CITY OF OSWEGO, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:

SECTION 1.  That it is hereby declared expedient and ordered that all of the platted alley extending east and west in Block 13, Cowell’s Addition and all of the platted alley extending north and south in Block 52,Original City (Maxson’s Addn.) of the City of Oswego, Kansas, be and the same is hereby vacated; provided, however, that said City of Oswego expressly reserves unto itself an easement and right of way, in, over, through, and across all of the alleyway hereby vacated for utilities to serve the public and particularly the owners and occupants of lots in said Block 13, Cowell’s Addn. and Block 52, Original City (Maxson’s Addn) of the City of Oswego, together with all rights necessary and convenient for the use of said right of way and easement to provide such services.

SECTION 2.  This ordinance shall take effect and be in force thirty (30) days after its publication in the Labette Avenue, the official city newspaper, unless one or more interested parties file a written protest before the expiration of such time as provided by K.S.A. 14-423.
