ORDINANCE NO. 1399
AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF OSWEGO, KANSAS AND IN COMPLIANCE WITH SECTION 22 OF ORDINANCE NO. 1107, PROVIDING FOR THE REZONING OF CERTAIN DESCRIBED REAL ESTATE FROM CP-1, COMMERCIAL WITH A CONDITIONAL USE TO RP-2 MEDIUM RESIDENTIAL AND VACATING ALL OF THE PLATTED ALLEY IN BLOCK 9, HOLLINGSWORTH SUBDIVISION, OSWEGO CITY.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:
SECTION 1. That the following described real estate is hereby rezoned from CP-1 Commercial with a Conditional Use to RP-2 Medium Residential, to wit:
Lots 1 through 12, Block 9, Hollingsworth Subdivision of the W ½ of the SW ¼, Section 26, Township 33, Range21, Labette County, Kansas except Railroad right of way. City of Oswego, Labette County, Kansas.
SECTION 2. That it is hereby declared expedient and ordered that all of the platted alley in Block 9, Hollingsworth Subdivision, City of Oswego, Labette County, Kansas be and the same is hereby vacated.
SECTION 3. Except as herein amended and previously amended, the Zoning Map of the City of Oswego, Kansas will remain in full force and effect. No change is made in the Zoning Ordinance of the City of Oswego, Kansas.
SECTION 3. That the Mayor be authorized to execute all documents necessary to effectuate this change.
SECTION 4. This ordinance shall take effect and be in force thirty (30) days after its publication in the Labette Avenue, the official city newspaper, unless one or more interested parties file a written protest before the expiration of such time as provided by K.S.A. 14-423.
ADOPTED by the Governing Body and approved by the Mayor of the City of Oswego, Kansas, this 12th day of March, 2018.
