Ord.1417 Jail Fee
ORDINANCE NO. 1417
AN ORDINANCE AMENDING THE CODE OF THE CITY OF OSWEGO, KANSAS, 2013, RELATING TO MUNICIPAL COURT COSTS BY AMENDING EXISTING SECTION 9-112 OF SAID CODE, AND REPEALING ORDINANCE NO. 1400.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:
SECTION 1. That Section 9-112, entitled, “COURT COSTS” be hereby amended to read as follows:
(a) The sum of $100.00 is hereby established for court costs in all cases in the municipal court of the city in which the defendant is adjudged guilty of the offense charged.
(b) The municipal judge of the city is hereby authorized and directed to assess and collect the sum of $100.00 in all cases in the municipal court of the city in which the defendant is adjudged guilty of the offense charged.
(c) The municipal court clerk of the city shall keep a record of, and pay into the general fund of the city at least once each month, all monies collected as court costs in all cases in the municipal court.
SECTION 2. Technology Fee – The sum of $5.00 is hereby established for a Municipal Court Technology Fee in all cases in the municipal court of the city in which the defendant is adjudged guilty of the offense charged.
SECTION 3. Jail Fee – The sum of $20.00 is hereby established for a Municipal Court Jail Fee in all cases in the municipal court for the city in which the defendant is adjudged guilty of any misdemeanor. The Municipal Court Jail Fee shall not be applied to any case where all adjudications of guilt are traffic infractions. Funds received from this section shall be deposited into the jail fund.
SECTION 4. In addition to the Municipal Court Jail Fee, the municipal judge of the city is hereby authorized and directed to assess and collect restitution from any person jailed for a period of one day or longer the sum of $20.00 per day; funds received from restitution under this section shall be deposited into the jail fund.
SECTION 5. No court costs, technology fees or jail fees may be assessed for seat-belt violations of persons age eighteen or older.
SECTION 6. Ordinance No. 1400 of the City of Oswego, Kansas is hereby repealed.
SECTION 7. This ordinance shall become effective after its publication in the official city newspaper.
